Terms of service
The short version: bored.kids is a free directory for grown-ups that anyone can add to. Listings are information, what you post is yours but we may publish and edit it, and what you buy from a provider is between you and them.
1. Agreement
bored.kids (the “site”) is run by Synthetic Media LLC, a Florida limited liability company (“we”, “us”). These terms, our privacy policy and our disclosures are a binding agreement between you and us. By using the site, or by posting or sending anything to it, you agree to them. If you don’t agree, don’t use the site.
Section 16 requires most disputes to be settled by individual arbitration, not in court, and waives class actions and jury trials. You can opt out within 30 days, as it explains.
2. Who can use the site
The site is made for parents, carers, teachers and other adults, and is not directed at children. You must be 18 or older (or the age of majority where you live) to post or send anything, vote, or otherwise contribute. If you use the site for a company, you agree to these terms for it too.
3. Listings and other content
Anyone can list a product on the site (see section 7). Listings, descriptions, guides, collections, rankings, ratings and other content on the site, whoever added them, are general information, and anything we write ourselves (“our content”) is our honest opinion. None of it is professional, educational, medical, developmental or safety advice, a certification of any product, or a promise about what a product will do for your child. Product facts come largely from providers and app stores and can change at any time or be incomplete or wrong. You use it at your own risk and decide what is right for your family.
We and our moderators decide, in our sole discretion, what to publish, how to describe it, which listings to feature, highlight or rank first, and whether to keep it, and we can add, change, combine, reorder or remove anything at any time without notice. Leaving a product out says nothing about it.
4. Other people’s products and sites
Most products on the site are made by other companies, and links take you to sites and app stores we don’t control. Anything you do with a provider, such as buying, subscribing, creating an account or sharing your child’s information, is solely between you and that provider, under their terms and policies. We are not responsible for their products, content, prices, availability, privacy or security practices, or conduct.
To the fullest extent the law allows, you release us and our owners, managers, employees, contractors and partners (together, the “bored.kids parties”) from all claims and losses arising from any third-party product or site, or from other users and what they post. If you are a California resident, you waive California Civil Code section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” You waive any similar law where you live.
5. Featured listings and money
Featuring and highlighting listings is at our moderators’ discretion. The site may show ads, some links may be affiliate links that earn us a commission, a maker may pay for a listing to be featured, and some listed products may be made by us or by companies connected to us. These relationships can influence what is listed and featured. Listings with a relationship are labelled, as explained in our disclosures.
6. Votes
Vote counts are a rough signal of interest, not a ranking or a measure of quality. They include votes cast on the site and votes sent to us in other ways, such as by email. We may correct counts, for example to remove duplicates, automated votes or abuse, but we never add votes that nobody cast. Don’t vote more than once for a product or use any automated means to vote.
7. What you post or send us
“Your content” means anything you post, upload or send to the site or to us: listings, reviews, ratings, comments, votes, photos, suggestions, corrections, listing details, removal requests, messages and feedback.
You keep ownership of your content. You grant us a worldwide, non-exclusive, royalty-free, fully paid, perpetual, irrevocable, transferable and sublicensable licence to host, store, copy, use, edit, adapt, translate, publish, display, distribute and create derivative works from your content, in whole or in part, in any media now known or later developed, for any purpose, including running, improving and promoting the site and our business. We may show it with the name or display name you give us, or without a name. To the extent the law allows, you waive any moral rights in your content and any right to approve how it is used.
When you list a product or send details about one, we may edit, shorten, combine, expand or replace what you send, including with details from the provider, and other people may add to or update the listing later. Your content is not confidential, and we owe you nothing for it, including for any idea or suggestion we use. If you send us a product’s name, logo, screenshots or other material, you allow us to use them to identify and describe that product.
8. Rules for your content
You are solely responsible for your content and the consequences of posting it. You promise that:
- it is yours, or you have every right needed to grant the licence above, and our use of it won’t infringe anyone’s rights or break any law;
- a review reflects your own honest, first-hand experience, and is not written about a product you make, sell or compete with;
- you say so in the review if you work for, are related to, or were paid or given anything by the provider of a product you review;
- it contains no personal information about a child, and none about any other person without their permission;
- it is not false, misleading, defamatory, harassing, hateful, obscene, violent or otherwise unlawful or objectionable;
- it is not spam or advertising, and contains no malware, tracking code or links placed for search ranking;
- you are not impersonating anyone or misrepresenting who you are.
9. Moderation
We may, but don’t have to, review, screen, edit (for example for length, clarity, formatting or to remove personal details), refuse, hide or remove any of your content, at any time, for any reason or none, without notice. We don’t publish everything we receive, so reviews and ratings shown on the site may not include every review or rating submitted. We may also block anyone from posting or using the site.
Content posted by users is the view of its author, not ours. We don’t verify it, endorse it or guarantee it is accurate, and we are not responsible for it. Under United States law, including 47 U.S.C. § 230, we are not the publisher or speaker of content provided by users, and moderating, editing or declining to publish it doesn’t change that.
If you think something on the site breaks these rules, report it through the contact form.
10. Copyright and removal requests
We respect copyright and expect users to do the same. If you believe content on the site infringes your copyright, send a notice through the contact form (choose “Remove or report something”) or by email to hello@boredkids.net that includes: your physical or electronic signature; the work you say is infringed; the material you want removed and where it is on the site; your contact details; a statement that you believe in good faith the use isn’t authorised by the owner, its agent or the law; and a statement, under penalty of perjury, that your notice is accurate and you are the owner or authorised to act for them. If your content was removed and you believe that was a mistake, you can send a counter-notice in the same way, as allowed by 17 U.S.C. § 512. We remove content of, and may block, people who infringe repeatedly.
Product names, logos and screenshots on the site are shown only to identify and describe the product they belong to. If you make a listed product and want its listing, name, logo or images corrected or taken down, tell us through the contact form and we will act on it promptly. Anyone can report other content they think is unlawful, inaccurate or about them through the contact form too.
11. Using the site fairly
Don’t use the site to break the law or anyone’s rights; access systems or data you aren’t allowed to; probe, overload or disrupt the site; get around any limit or security measure; use bots, scrapers or other automated means to access the site, post, vote or copy content; copy the directory in bulk or use it to build a competing service or train AI models; or help anyone else do any of this.
12. Our rights in the site
The site, including its design, text, graphics, software, and the selection and arrangement of listings, belongs to us or our licensors and is protected by law. We give you a limited, revocable, non-transferable permission to use the site for your own personal, non-commercial purposes under these terms. bored.kids and its logo are our trademarks. Product names, logos and screenshots belong to their owners and appear only to identify and describe their products; showing them doesn’t mean the owner endorses us or we endorse them.
We may suspend or end your access to the site, or any part of it, at any time, for any reason, without notice or liability.
13. No warranties
THE SITE, OUR CONTENT AND USER CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS. TO THE FULLEST EXTENT THE LAW ALLOWS, THE BORED.KIDS PARTIES DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY ABOUT ANY THIRD-PARTY PRODUCT OR SITE. WE DON’T PROMISE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.
14. Limits on our liability
TO THE FULLEST EXTENT THE LAW ALLOWS, THE BORED.KIDS PARTIES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, MONEY OR GOODWILL, ARISING FROM OR RELATING TO THE SITE, OUR CONTENT, USER CONTENT, ANY THIRD-PARTY PRODUCT OR SITE, OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF WE WERE TOLD THEY MIGHT HAPPEN. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE OR THESE TERMS IS LIMITED TO THE GREATER OF US$50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
15. Your responsibility to us
You will defend, indemnify and hold harmless the bored.kids parties from all claims, demands, losses, liabilities, damages, fines and costs (including reasonable legal fees) arising from or relating to your content, your use or misuse of the site, your dealings with any provider, or your breach of these terms or of any law or anyone’s rights. We may take over the defence of any such claim, and you will cooperate with us.
16. Disputes and arbitration
Talk to us first. Before starting any claim, send us a description of it and the relief you want through the contact form, and give us 60 days to try to resolve it informally.
Arbitration. If it isn’t resolved, you and we agree that any dispute, claim or controversy arising from or relating to the site or these terms, including whether this section applies, will be settled by final and binding individual arbitration under the Federal Arbitration Act, administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator. The arbitration will take place in Florida or, at your choice, by video or on written submissions. Either party may instead bring an individual claim in small-claims court, and either party may go to court to stop infringement or misuse of its intellectual property.
No class actions or juries. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective, consolidated or representative action, and the arbitrator may award relief only to the individual party. You and we waive any right to a jury trial.
Opting out. You can opt out of arbitration by telling us so through the contact form within 30 days of first agreeing to these terms. If you opt out, or if this arbitration agreement is found unenforceable, disputes will be decided only by the state or federal courts located in Florida, and you and we consent to their jurisdiction; the class action and jury waivers still apply to the extent the law allows.
Time limit. Any claim must be started within one year after it arose, or it is permanently barred.
17. Governing law
These terms and any dispute are governed by the Federal Arbitration Act and the laws of the State of Florida, USA, without regard to conflict-of-law rules. Nothing in these terms takes away rights that the law where you live says cannot be limited or waived; where that applies, our disclaimers, limits and releases apply to the greatest extent that law allows.
18. Changes and the rest
We may update these terms by posting a new version here with a new date; using the site after that means you accept them. We may change, suspend or close the site at any time. These terms, the privacy policy and the disclosures are the whole agreement between you and us about the site. If any part is found unenforceable, it will be limited as little as needed and the rest stays in force. If we don’t enforce a term, we haven’t waived it. We may transfer these terms, including the licence to your content, to anyone; you may not. We aren’t liable for delays or failures caused by events beyond our reasonable control. You agree we can give you notices electronically, including on the site. Sections 3 to 18 survive the end of your use of the site. There are no third-party beneficiaries except the bored.kids parties.
19. Contact
Questions about these terms go through our contact form. You can also email hello@boredkids.net.
